Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DriveX mobile application and related services (the "App"), operated by Driven Technologies ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the App. By using the App you represent that you meet these requirements.

2Your Account

• You may register with email or sign in through Google or Apple.
• You are responsible for keeping your credentials secure and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• Notify us promptly of any unauthorized use of your account.

3License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. We reserve all rights not expressly granted.

4Acceptable Use

You agree not to:

• Use the App in any unlawful way or in violation of traffic or vehicle laws.
• Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems.
• Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
• Copy, resell, or commercially exploit the App or its data without our permission.
• Upload content that is unlawful, infringing, or that you do not have the right to provide.

5Your Content and Information

You may add information such as vehicle and insurance details. You represent that you have the right to provide this information, and you grant us the right to store and process it to operate the App as described in our Privacy Policy. You are responsible for the accuracy of the information you provide.

6Third-Party Services

The App relies on third-party services, including Google (routing and sign-in), Mapbox (lane and directions data), Apple (sign-in and CarPlay), and weather data providers. Your use of features that depend on these services may be subject to their terms and policies. We are not responsible for third-party services, and their availability or accuracy is not guaranteed.

7No Guarantee of Accuracy

Routes, lane guidance, estimated arrival times, road-condition and roughness data, weather, and other information are provided for convenience and may be incomplete, outdated, or inaccurate. Real-world conditions — road closures, construction, traffic, signage, and hazards — take precedence over any information in the App. Use your own judgment at all times.

8Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT ANY INFORMATION IT PROVIDES IS ACCURATE OR RELIABLE.

9Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVEN TECHNOLOGIES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING ANY RELIANCE ON NAVIGATION OR ROAD INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10Indemnification

You agree to indemnify and hold harmless Driven Technologies from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms or applicable law.

11Termination

You may stop using the App and request account deletion at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination will survive.

12Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide additional notice in the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Davidson County, Tennessee, unless applicable law requires otherwise.
